A Michigan man has filed a federal lawsuit claiming his constitutional rights were violated when he was ordered to remove a Nativity scene from the median of a public road a creche that his family has displayed at the location for 63 years.
John Satawa, of Warren, Mich., filed the lawsuit in U.S. District Court on Friday in an attempt to be allowed to put back the 8- by 8-foot nativity scene his late father built in 1945.
After receiving a complaint by the Wisconsin-based Freedom From Religion Foundation last December, the Road Commission of Macomb County told Satawa to remove the holiday display, citing incomplete permits. Satawa's permit application was later denied because it "clearly displays a religious message" and violated "separation of church and state," Macomb County Highway Engineer Robert Hoepfner wrote.

Did he put the creche up only at Christmas, the article makes it sound like it’s always there. And if its on public property it’s not up to him to take it down, the city could remove it if if it wanted to or any citizen could walk up and take it down. Should be an interesting case. Does anyone have a photo?

Thanks. It looks like a log cabin, which is what mangers may have looked like. This may be one of the most realistic mangers in the country.
If the do-nothings beat them in the court case I hope they find a good private lawn to put it on.
I beleive in one of the ammendments, right after it states that the government shall establish no religion, it also says “nor prohibit the free exercise thereof”.
Is this guy nuts? We put up Christmas decorations every year in, on and around our house, but it’s on our own private property. Once people start taking it upon themselves to do things on their own to public property, they are assuming that they know what is best for everyone.
