Agreed... There will be no lawsuit from this slug.
In my many years of experience in business, I have ALWAYS witnessed one constant - when someone threatens to sue, he really has no case, and knows it. A person who really has been damaged and has a real clear cause of action doesn'tt threaten suit, he simply brings it and sues.
Sharptons gross inability to keep his pie-hole shut is only exceeded by his manifest irrelevance in all things political, social and financial or anything else of any significance in our world.

I know who to bet on just so long as they dont get an OJ jury. Therein lies a very large problem. There are venues where Rush would have zero chance of winning -- even if he had video of Rev. Al acting as charged. Not to mention DNA evidence...
