Basically, Congress is the one who gets to say whether these appointments require approval, not an expert panel, not the President.

In effect, they acknowledge that if it were brought to a court of law, nothing these czars do or require is enforceable. The "practical authority" weilded by these czars is, by their own admission, nothing more than a power grab.
Bullies have no legal right to their classmates' lunch money, either. Just the "practical authority" of being bigger, meaner, greedier, all around a**holes.
