APF sounds like a federally funded police/security organization....that’a the rub.
If APF were federally funded, it wouldn’t be operating out of a single room in an office building next to a strip mall in Santa Ana, CA.
If they were federally funded, their lawyer wouldn’t be a fourth rate personal injury lawyer.
This group has amateur hour written all over it. They look like a bunch of swindlers looking for a payday.
It's an interesting question. There's certainly federal funds at play. Then again, there are federal funds at work in some of these privately run prisons as well. I'm just not familiar enough with the relevant case or statutory law to really render a worthwhile opinion.
Some judge, somewhere would have to find that these would indeed be "uniformed members of our armed forces". It's not an impossible conclusion to reach, IMHO.
