Department of Health and Human Services Secretary Kathleen Sibelius has not only given immunity to the makers of Tamiflu and Relenza for injuries stemming from their use against swine flu, she has granted immunity to future swine flu vaccines and any associated adjuvants. The last time the government embarked on a major vaccine campaign against a new swine flu, thousands filed claims contending they suffered side effects from the shots. This time around, they will have no recourse.
The 2006 Public Readiness and Emergency Preparedness Act (the PREP Act) allows the DHHS Secretary to invoke almost complete immunity from liability for manufacturers of vaccines and drugs used to combat a declared public health emergency.

I have never, ever gotten a flu shot. I see no reason to start now, especially in light of this.
Can she “grant immunity”? On what basis can a civil suit be quashed?
Nice how they cant be sued on this but she does not want torte reform. Is she talking out of both sides of her horse mouth?

I am all for tort reform. I am not into bashing the pharmacy industry. However, NOBODY should be granted blanket immunity for bodily harm given the stakes. This is simply a move towards mandatory immunizations so local and state officials will have cover.
To liberals “choice” only matters if the problem is killing babies.
Neither have I. I also don’t get the flu.

Nice...what group is most susceptible to the dangers of Swine Flu?..The very young and the elderly...O’s team has no sympathy for the elderly especially, so this comes as no surprise...Just wait—we’ll be around in 2010 and 2012 and we’ll remember this and we’re gonna get these dirty Rats...
No recourse...that’s what this administration wants for everything
they believe in. To hell with America.
