What ever he may have claimed it to be, a 40 year old man with an 13 year old girl is rape! No questions, not excuses. This is not the 20 year old with the 17 year old girl we often hear about.
I don't really give a damn about the circumstances when a man old enough to be her father messes with a minor. As adults, we have an obligation to protect children, not to abuse them.
And if she were my daughter, the SOB would have begged them to put him in high security at least until I was dead because I would have enforced a different law than the state does.

I think what she was TRYING to say was that it wasn’t forcible rape. She wants to make it look like statutory rape. IMHO, a 19 year old boyfriend having sex with his minor girlfriend is statutory rape. A 45 yr old have sex with a 13 yr old girl is rape-rape whether it was a forcible rape or not.

Surprisingly, the NYT today said that putting Polanski in jail was exactly the right thing to do. I guess there are limits on what even liberals will tolerate.
California law lists duress in the same sentence as violence when describing rape:

Not to mention drugging the victim:
(3) Where a person is prevented from resisting by any intoxicating or anesthetic substance, or any controlled substance, and this condition was known, or reasonably should have been known by the accused.
