He's brilliant because he's not sitting in jail rotting and he is able to get himself back into a position to scam people time after time even after he gets caught. Looking at his rap sheet, he's had ample access to plenty of cash from his co-defendents/investors and there's a good chance he's stashed away some of it, otherwise he wouldn't keep doing it.
As far as the money, the guy is a con artist with a history. There is no money and probably the only people actually backing this are a string of aliases that all lead back to Hilton or fellow con artists.
You have to remember - nobody has actually seen the money. It wouldn't be hard for somebody like him to manufacture fake paperwork to fool the newspaper reporter who quit her job to work for him.
It's a fairly simple con actually - you get these idiots in Hardin to start thinking about some huge facility you want to build down the road as well as the jobs it will bring along with trying to become Gitmo North, and all they see is dollar signs and re-election. They lose focus of what he's actually doing which is trying to get far enough into the scam to get their money for the existing setup.
He gets them focused on some mythical facility in the future, then he has ample time to come up with an excuse of why he can't build said facility.
