I do not know about Maryland, but in my state, if they are not a corporation, or a registered foriegn corporation, they do not officially exist, and therefore lack any standing to file a suit. As individuals, yes. But not as an organization. Perhaps a real lawyer could comment.

At the time of filming, their registration had lapsed [by 2+ years]. Prior, IIRC, to filing suit, they paid their fee and re-registered with the State of Maryland.
