FR Question: Why are people so hung up on elements of the bill when the whole bill on it’s face is unconstitutional because Article 1 Section 8 of the Constitution does not expressly list regulating health care as a power granted to Congress?

It's not only what she knows but also what all members of Congress know. Assuming she doesn't know, then it is up to the people to demand she abide by the Constitution.

And would it even matter?

What the people want doesn't matter to her and many other members of Congress but that hasn't stopped the people from pressuring their Congress critters on individual provisions on the bill. Given people are willing to expend all that energy, they might as well do so by emphasizing the most important, being the Constitution.
