He did eh?! Ultimately, the 82 year old Hemenway was reprimanded for his Rule 11 violation. To my way of thinking, the judge showed great, and commendable, restraint, no doubt because of Hemenway’s advanced age and the what appears to be the judge’s suspicion that Hemenway was used by Berg. Hemenway appealed the reprimand acting as his own attorney. I don’t know the status of the appeal. I do know that there is a legal truism which some might suggest applies here:
“He who has himself for an attorney has a fool for a client.”
Eventually, someone involved in one of these suits to cause mutiny in the ranks, or who participates in a conspiracy to advance these lawsuits, will quite rightfully be prosecuted for violations of 18 USC Sec. 2387 or 2388 and hopefully spend a long time in a Federal penitentiary.
