Jonathon needs to hire a laywer. But at least it sounds like he has title insurance. I have never seen title insurance cover anything. It is the most grossly overpriced form of insurance. The recourse will be from the Real Estate Agent who probably has errors and omission insurance.

There are issues which have arisen from errors in title, but you are correct, they are few and far between.

Dad got a pay-out from the title company over a deed restriction that they missed. He wound up building a single story building instead of a multistory, and they paid dearly for the screw up. That is the ONLY title company payout I've ever heard of.
