So the hearing to decide on the dismissal is to be held at a later date, so the motion to dismiss brought by Obama’s attorneys has not yet been ruled upon, correct?

Judge Carter stated it would darn near take an act of GOD to dismiss this case.
That ain’t exactly what he said, but that’s exactly what he meant. The Motion to Dismiss will be heard on October 5.

The stated according to the Federal Rules of Civil Procedure that this case is very rarely dismissed.
Obama's lawyers had a weak case and the judge wants to proceed in a timely manner.
