UK-- Woman arrested in her home for drunk driving
UK Daily Mail | 02nd September 2009 | By Simon Cable

Posted on 09/02/2009 6:42:09 PM PDT by dennisw

Can this happen anywhere in the United States?
Police come to your home and demand a breathalyzer test because they have reports that your were driving drunk?
Plus it looks to me like the coppers provoked a struggle in order to arrest her
Wouldn't you be upset if police came to your door and accused you of driving drunk?

Article from UK Daily Mail
During the hearing, the court had heard how police arrived at her home on May 31 after receiving reports she smelled of alcohol at a garage near her home in south-west Wales. She refused to give a breath sample and it was claimed she had to be handcuffed after she began struggling and shouting at officers. Mrs Fisher also said she could not be breathalysed because she was 'assaulted and manhandled' and also claimed she had a bronchial infection, although she had no evidence to support the claim.

A local lawyer just got away with this. Hit and run, ran home hid the car, drank somemore. By the time the cops got there, they could no longer prove she was drunk while behind the wheel.

Leaving the scene yes.....DUI, no.

I’ve heard of things like that before, here in the US.... apparently they can arrest you for [DUI] sleeping in your car even if you’re not driving.

This woman had parked her automobile and was inside her house. I think it’s a little bit too late for police to come and demand a breathalyzer test

If the keys are not in the ignition I don’t think they can arrest you for DUI sleeping.

Couldn’t they also come to your house and accuse you of rape?

They could knock on the door, tell you to drop your pants -— then say, “Yep, he has the ‘equipment’, therefore, he must be guilty of rape!”

You can be arrested for enjoying a cocktail in your own front yard while watching your grandchildren wash your car if the keys are in the ignition because they want to listen to the radio.

I heard, from a police-man, that even if it’s within reach... like say you’re in the front-seat and threw the keys into the passenger foot-well.

My former neighbor.

I witnessed the whole thing and heard about the consequences for months on end while he endured the license suspensions, re-education camps, MADD's live theatre, probation invasions, ignition interlock and legal fees.

Start to finish - roughly 3 years.

Monetary damage in excess of $25K.

A guy in AZ got busted in his house. He was asleep and in his skivvies. No property damage, just a witness. (1993)

(keys are in ignition to turn radio on)

So nice hot sunny day, I am in my driveway washing my car and have its radio on. I’m drinking three beers while washing it.....And I can be arrested for drunk driving?
