In a case that again raises the issue of when homosexual workers may sue under federal civil-rights law, a federal appeals court has revived a Pittsburgh-area man's suit contending that he was harassed and fired because of his "effeminate behaviors."
The unanimous opinion by a three-judge panel of the U.S. Court of Appeals for the Third Circuit reinstated the 2006 lawsuit by Brian D. Prowel against Wise Business Forms Inc. and remanded it for trial by a federal judge in Pittsburgh.
Prowel, 39, of Penn Hills, who operated a business-forms coding machine at Wise for 13 years, issued a statement saying, "Sometimes you have to fight for right. The decision . . . recognized that no employee should have to go through what I went through."
According to the Third Circuit opinion filed Friday, Prowel's self-described effeminate mannerisms led coworkers to nickname him "Rosebud" and "Princess" and leave such items as a pink, feathered tiara and antigay religious tracts on his desk.

Interesting case as the issue is his firing, not the actions of his coworkers.
The sad thing is this guy may not even be gay. Maybe he is just short or small in size. He did his job for 13 years only to be constantly humiliated by his coworkers.
I feel bad for the guy-whether he was gay or not.
I agree, I have known a few guys who were a bit effette but were straight as an arrow. Their lives were sometimes hell for them.
You make some good points. Maybe I have the wrong attitude but if I don’t like where I am and no one seems to do anything about it, I look for another job.

Third Circuit Judge Thomas M. Hardiman wrote: "Wise cannot persuasively argue that because Prowel is homosexual, he is precluded from bringing a gender stereotyping claim.
Apparently you can act any way you want at work.
Never washing, wearing filthy clothes, constantly belching - or acting like a flaming fruit - you name it and your co-workers must put up with it.
