LOUISVILLE, Ky. (Aug. 31) - A judge ruled Monday that prosecutors withheld evidence in the trial of an ex-high school football coach charged with reckless homicide in the death of one of his players. The ruling came on the opening day of jury selection in David Jason Stinson's trial. The former Pleasure Ridge Park coach is also charged with wanton endangerment in the death of 15-year-old offensive lineman Max Gilpin, who collapsed during practice while running in 94-degree heat last August. Gilpin died three days later

I want everyone to read this and for those of you who spent days telling me how wrong I was the last time I posted this story I especially want you to pay attention.

Prosecuting this coach is TOTALLY wrong. Lots of people jumped to bad, unfounded conclusions just like I said. The prosecution's case is so weak their own expert witness wouldn't testify to what they wanted him to say. He said it was an accident. Do you think they would drop it? OF COURSE NOT. Prosecutors aren't out for Justice, they are out to WIN. That is a failing in our system.

We have the same problem but without the heat. In August, it stays below 80 during practice time. When it is cooler, the coaches forget to hydrate the kids. The coaches are standing still so they don’t think about it.

Last game, my son played in all but 6 plays. He did not hydrate in the 2nd half. That was not pretty.

The kids need to hydrate BEFORE the practice or game. Halftime is hydrate time. You cannot make up for bad hydration while working out.

It seems hydration wasn’t the problem. Heat Stroke may have been caused by the kid’s Medication.

Yup, the medication is definitely part of this. Coach should not be prosecuted.

You want us to read that:

1. the prosecution case is so weak the prosecutor felt he had to withhold evidence?

2. included in that evidence is that even one of the prosecutions experts thought it was not a homicide?

3. the young man who unfortunately died was taking a drug that contributed to his death?

Maybe you did not read the story? Unless their is outrageous behavior on the part of a coach in a situation like this it is not criminal behavior and the state should stay out of it.

The death was, of course, a tragedy.

I have heard no evidence to suggest the coach was at fault though. Just another case of a power hungry prosecutor IMHO.

How can you possibly misread my post? Re-read it. The system needs to be changed because PROSECUTORS jump to conclusions and can’t be shaken from them with evidence.

Sorry, I did not understand your post. I saw some people in favor of the prosecution and some against when this sad event happened. I just misread what you were saying.

No problem. You and I totally agree. I think prosecutors are far too eager to prosecute every bad event whether a crime was committed or not. Worse, once a prosecutor starts down that road they are not willing to give up when the evidence starts to show them clearly that they are wrong.

Individuals should not be subjected to a trial just because a prosecutor doesn't want to admit they were wrong in the first place.

I was flamed relentlessly by several people here when I complained about this action being brought in the first place. I told them all this man would never be convicted and the prosecutor was simply wasting time and money that should be used elsewhere.

Keep opposing out of control prosecutors!
