Every supporter who made a donation of $5 or more between July 26th and July 31st took part in our second Dinner with Barack campaign.

On Labor Day, September 3rd, four lucky supporters from all over the country will join Barack for an evening of good food and good conversation.

Did the Obama Campaign conduct an illegal gambling operation?

Sample gambling law (state of Washington; This is pretty typical of most gambling laws. http://www.wsgc.wa.gov/faq/internet_gambling.pdf

Internet gambling has always been illegal in Washington State and in the United States. Washington State Internet Gambling Law A bill was passed during the 2006 Legislative Session changing the penalty for Internet gambling from a gross misdemeanor to a class C felony. The bill became effective June 7, 2006.

...What is Gambling? Gambling involves three elements: prize, chance and consideration (entry fee, wager, or anything of value). If one of these elements is removed, it is no longer a gambling activity. For example, if you pay a fee to play a game of chance (such as poker, blackjack, bingo, roulette, craps, slots, etc.) for a prize, it is a gambling activity. However, if you play these games for free (no entry fee or wager) it is not a gambling activity and is okay to play on the Internet.

Although the Obama campaign later--after complaints from Minnesota law enforcement--removed the requirement of an entry fee (a donation to the Obama campaign), the solicitation in question, of which I received a copy, did not include the option to enter without a donation.

"four lucky supporters" = chance, although the pre-selection of Ms. Unrah as a winner (http://obamasharpton.blogspot.com/2008/08/obama-illegal-foreign-contributions-and.html) before closure of entries suggests that the Obama campaign ran not only a gambling event, but a rigged one in which not everybody had an equal chance to win.

"will join Barack for an evening of good food and good conversation" = prize

Do any attorneys want to weigh in on the legality of this fundraising method and on whether Eric Holder, who is very diligent in prosecuting CIA agents for aggressive interrogation of terror suspects, has a duty to appoint a special prosecutor to determine whether the Obama campaign engaged in gambling across state lines, and rigged gambling in the bargain.

Washington State adds,

RCW 9.46.220 Professional gambling in the first degree. (1) A person is guilty of professional gambling in the first degree if he or she engages in, or knowingly causes, aids, abets, or conspires with another to engage in professional gambling as defined in this chapter, and: (a) Acts in concert with or conspires with five or more people; or (b) Personally accepts wagers exceeding five thousand dollars during any thirty-day period on future contingent events; or (c) The operation for whom the person works, or with which the person is involved, accepts wagers exceeding five thousand dollars during any thirty-day period on future contingent events; or (d) Operates, manages, or profits from the operation of a premises or location where persons are charged a fee to participate in card games, lotteries, or other gambling activities that are not authorized by this chapter or licensed by the commission. (2) However, this section shall not apply to those activities enumerated in RCW 9.46.0305 through 9.46.0361 or to any act or acts in furtherance of such activities when conducted in compliance with the provisions of this chapter and in accordance with the rules adopted pursuant to this chapter. (3) Professional gambling in the first degree is a class B felony subject to the penalty set forth in RCW 9A.20.021.
The exceptions can be found at http://apps.leg.wa.gov/RCW/default.aspx?cite=9.46.0305. It seems legal (not legal advice as I am not a lawyer) to bet on who will pay for a meal or jukebox music, nonprofit fundraising, social card games, agricultural fairs, sports pools, and so on. Nowhere can I find an exception for fundraising for a political campaign.

and this isn’t the first time! early on in obummer’s campaign there were issues with this very same circumstance.
