In Article I, Section 8, of the Constitution, states that The Congress shall have Power
Congress is the key. If Obama tries to mobilize the CSF by presidential order or by order of the department of homeland security the Military is bound by the constitution to disarm and disband it.
As i pointed out if Congress if forced to confront that arming this force will cause a Civil War they will never approve it. I don't see men like Leiberman wanting that kind of blood on their hands. We only need a few senators to get queasy about starting a full scale civil war and this won't pass the senate. And the Military can stop Obama from raising and arming it without congressional approval.

Surely you don't think this would be done in the open, with truckloads of guns and uniforms being handed out to create a visible force?

I hope you’re right but if the infrastructure is in place and those in Congress who may hesitate are threatened, well...I don’t think I have to draw you a picture.
