The Alliance Defense Fund (ADF) has asked a New Hampshire court to reconsider its decision to order a 10-year-old home-schooled girl into public school.
"Parents have a fundamental right to make educational choices for their children," said ADF-allied attorney John Anthony Simmons. "In this case, the court is illegitimately altering a method of education that the court itself admits is working."
The parents of the girl are divorced, and the mother has been home-schooling her. In the process of renegotiating the terms of a parenting plan for the girl, the guardian ad litem concluded that the girl "appeared to reflect her mother's rigidity on questions of faith" and that the girl's interests "would be best served by exposure to a public school setting."
Judge Lucinda V. Sadler approved the recommendation and issued the order July 14.
"The New Hampshire Supreme Court itself has specifically declared, 'Home education is an enduring American tradition and right,' " said ADF Senior Legal Counsel Mike Johnson. "There is clearly and without question no legitimate legal basis for the court's decision, and we trust it will reconsider its conclusions."
Mike Donnelly, staff attorney at the Home School Legal Defense Association, agreed this is "not the place for the courts to be inserting themselves."
That is not true when it comes to these cases.
Courts usually give primary custody to mom. But they don’t rule for home schoolers, mom or not.
Does anyone in this brouhaha know specifically WHAT the “religious beliefs” of the mother and daughter were that came into question before the court? Maybe they believe in magic mushrooms, for all we know. We are but chasing our tail until we know more.

Since YOUR above italicized statement had nothing to do with argument, but was pure ad hominem attack against someone you obviously didn't know, I didn't need to rescue anyone but you. Freepers know attacks on character when they see them.
So, I figured I'd rescue you from the evil god Stupid. Figured maybe I could steal your sacrifice to him before you actually laid that egg on the altar.
If you know anything about the law, you will know that most rulings like these don't make a whole lot of sense one way or the other. This is why parents need to work these things out and even if they are divorced, if they both claim to be Christians, then they need to be worked out in a Biblical manner and if you know your bible, you will know that when there is a tie, the deciding vote goes to the husband.
You may think that is unfair (and it very well may be "unfair"), but that is the biblical standard. If you want to reject the Bible and insist that the wife has as much of a right to make a final decision on the raising of the children as the husband, then you are going to end up with the courts making these decisions.
As a Christian we must accept the order that the Bible sets down for marriage and that order gives the responsibility for the final determination of marital matters to the husband. (I dare say that in most cases husbands (if they know what is good for them) defer to their wives on nearly every decision).
Even though the parents are divorced before the world, the fact that they have a child means that in the eyes of God they are still married, and that is something that no man can put asunder.
So from a purely biblical standpoint, the decision to have the child full time in public school was made by the person to whom GOD gave the responsibility for the decision. When the wife refused to honor that request and put it before the courts, the courts then became the instrument of God in making that determination. The courts honored the Father's request, which is the Biblical model in the first place.
I therefore suspect that it is, in fact, God's will that this child be sent to public school, at least until such time as God chooses to convince the husband that perhaps this is not such a good idea. If he is at all a protective dad, she will be back at homeschool in no time at all.

WHOA! Not all you are saying is true. Nowhere can you find scripture to back up the comment about being married in the eyes of God just because they have a child. God does give reason for divorce in the Bible. We do not know if they met that requirement.
If the religion were causing physical harm or criminal activity, it would matter. But that is not the case here. So, if they are loonies out in the woods worshipping mushrooms, they have that protected right.
What is your evidence that this is “not the case here”?

That’s what I think — the father is getting back at the mother. And the GALs are just volunteers — there is no way THAT should be the deciding factor.
I can show you the verses that back up my point, however if I were to show you them, would you conceed that from a biblical standpoint, if there is a marital dispute between the husband and the wife about where the child will go to school, that according to the Bible, God has placed the authority for the final decision on that matter with the husband?
If you are not willing to conceed that point during a marriage, then those Bible verses would certainly not be of any value in a case where the husband and wife have obtained a Civil declaration of divorce.
God does give reason for divorce in the Bible. We do not know if they met that requirement.
Well the "biblical" excuse for divorce is "adultery", isn't that true?
What was the biblical punishment for adultery?
My guess is that with the money these parents have wasted dragging each other to court rather than acting like adults and resolving these disputes amicably, they could have put this child through medical school.
