Because he volunteered for overseas service. His remedy was to unvolunteer. The government recognized that and rescinded his orders. He has no remedy in court. Orly is not a good lawyer.

His remedy was to unvolunteer.

When orders are issued, the soldier cannot "unvolunteer." The government makes the decision, not the individual soldier.

Or, maybe I didn't understand your post.
