Most of the pages I read do NOT say what you wrote.

You are not doing anyone a service by misinterpreting the facts. This bill is bad enough without any help of the kind you give in this post.

• Page 22: Mandates audits of all employers that self-insure!

No it does not, it references a plan to study all types of employer health insurance including self-insurers.

• Page 29: Admission: your health care will be rationed!

There is no reference to rationing on page 29.

• Page 30: A government committee will decide what treatments and benefits you get (and, unlike an insurer, there will be no appeals process)

This is in the document.

• Page 42: The “Health Choices Commissioner” will decide health benefits for you. You will have no choice. None.

Whether or not you have a choice depends on what the Health Commissioner decides. This just puts that ball in his court. The decision has not been made.

• Page 50: All non-US citizens, illegal or not, will be provided with free healthcare services.

I found no reference to this on page 50.

• Page 58: Every person will be issued a National ID Health card.

No. This is a reference, in general, to how health care works. I have had a health card for years.

• Page 59: The federal government will have direct, real-time access to all individual bank accounts for electronic funds transfer.

This is only for those claiming they cannot afford the out of payment expenses. (It is still wrong).

• Page 65: Taxpayers will subsidize all union retiree and community organizer health plans (read: SEIU, UAW and ACORN)

Page 65 says no such thing. Also, the taxpayers already pay for everything for SEIU. And there is no reference to ACORN anywhere in the document.

• Page 72: All private healthcare plans must conform to government rules to participate in a Healthcare Exchange.

It does say this.

• Page 84: All private healthcare plans must participate in the Healthcare Exchange (i.e., total government control of private plans)

It does not say that. It states that if a private plan participates, there are regulations for them to qualify.

• Page 91: Government mandates linguistic infrastructure for services; translation: illegal aliens

It does say that.

• Page 95: The Government will pay ACORN and Americorps to sign up individuals for Government-run Health Care plan.

The document does not name any group to be paid, simply that any group that does the “educating” about this bill will be determined later and, yes, will be paid.

• Page 102: Those eligible for Medicaid will be automatically enrolled: you have no choice in the matter.

It does not say that. It says that certain people who are not eligible for Medicaid can join this bill and that the others will be automatically enrolled.

• Page 124: No “judicial review” is permitted against the government monopoly.

It does say no judicial review.

• Page 127: The AMA sold doctors out: the government will set wages.

Government will only set the wages for this health care bill, the same as private insurance sets the wages for doctors regarding private insurance.

• Page 145: An employer MUST auto-enroll employees into the government-run public plan. No alternatives.

It does not say that.

• Page 126: Employers MUST pay healthcare bills for part-time employees AND their familie s.

No, employers must pay a portion of the premiums for part-time employees, not their medical bills.

• Page 167: Any individual who doesn’t have acceptable healthcare (according to the government) will be taxed 2.5% of income.

It does say that.

• Page 195: Officers and employees of Government Healthcare Bureaucracy will have access to ALL American financial and personal records.

Again, this is only for those that join this health care bill who claim they cannot afford the out of pocket expenses.

• Page 203: “The tax imposed under this section shall not be treated as tax.” Yes, it really says that.

I did not read this page.

• Page 239: Bill will reduce physician services for Medicaid. Seniors and the poor most affected.”

That is not what it says.

• Page 241: Doctors: no matter what specialty you have, you’ll all be paid the same (thanks, AMA!)

For the same service. Doctors visits will all pay 1 amount, hospital visits will all pay another amount, etc.

• Page 253: Government sets value of doctors’ time, their professional judgment, etc.

It does state this.

• Page 265: Government mandates and controls productivity for private healthcare industries.

No, this is a study, not a mandate or control.

• Page 272: Cancer patients: welcome to the wonderful world of rationing!

That is not what it says. It could lead to that, but there is no rationing referred to. This is a reference to decisions yet to be made by the commissioner.

• Page 318: Prohibition on hospital expansion. Hospitals cannot expand without government approval. • Page 321: Hospital expansion hinges on “community” input: in other words, yet another payoff for ACORN.

Community does not equal ACORN. This is a reference to medical facilities that want to convert to Hospitals. It is normal proceedure now for the homes and businessses in the area to be asked for an opinion about how the difference in traffic might affect them.

• Page 335: Government mandates establishment of outcome-based measures: i.e., rationing.

Outcome-based measures means they will not pay for experimental treatments. Private Insurance doesn’t pay for it either.

• Page 341: Government has authority to disqualify Medicare Advantage Plans, HMOs, etc.

It does say this.

• Page 354: Government will restrict enrollment of SPECIAL NEEDS individuals.

It does not say that. It refers to looking at all the Special Needs programs and determining if they are cost effective.

• Page 425: More bureaucracy: Advance Care Planning Consult: Senior Citizens, assisted suicide, euthanasia?

There is no reference to euthanasia or anything like it. It does, however, mandate Seniors over 65 have this consultation every 5 years, and can happen more often, but no mandate on how the seniors are respond.

• Page 425: Government will instruct and consult regarding living wills, durable powers of attorney, etc. Mandatory. Appears to lock in estate taxes ahead of time.

Instruct and consult does not mean the government gets any control.

• Page 425: Government provides approved list of end-of-life resources, guiding you in death.

This can be such things as a patient giving their doctor an order to not give chemo therapy, not do any surgeries, etc. The bill does state this has to be signed by a doctor and other health professionals have to abide by it. This is happening now and has been for a long time.

• Page 427: Government mandates program that orders end-of-life treatment; government dictates how your life ends.

It does not order end-of-life treatment.

• Page 429: Advance Care Planning Consult will be used to dictate treatment as patient’s health deteriorates. This can include an ORDER for end-of-life plans. An ORDER from the GOVERNMENT.

The order is not from the government, it is an order you give to your doctor and your doctor signs. It has been going on for a long time.

• Page 430: Government will decide what level of treatments you may have at end-of-life.

That goes back to the decisions that have not been made by the commissioner. The decisions have not been made yet.

• Page 469: Community-based Home Medical Services: more payoffs for ACORN. • Page 472: Payments to Community-based organizations: more payoffs for ACORN.

This is a reference to Hospice, nursing homes etc. This has nothing to do with ACORN.

• Page 489: Government will cover marriage and family therapy. Government interferes in your marriage.

It does say this.

• Page 494: Government will cover mental health services: defining, creating and rationing those services.

It does say this.

SEC. 113. INSURANCE RATING RULES.
(a) IN GENERAL.—The premium rate charged for an
insured qualified health benefits plan may not vary except
as follows:(1) STUDY.—The Commissioner, in coordination with the Secretary of Health and Human Services and the Secretary of Labor, shall conduct a study of the large group insured and self-insured employer health care markets. Such study shall examine the following:
A) The types of employers by key characteristics, including size, that purchase insured products versus those that self-insure.
(B) The similarities and differences be7
tween typical insured and self-insured health plans.
(C) The financial solvency and capital reerve levels of employers that self-insure by employer size.
(D) The risk of self-insured employers not being able to pay obligations or otherwise becoming financially insolvent.
(E) The extent to which rating rules are likely to cause adverse selection in the large group market or to encourage small and mid size employers to self-insure

(c) LIMITATION ON PHYSICIANS’ SERVICES INCLUDED IN TARGET GROWTH RATE COMPUTATION TO SERVICES COVERED UNDER PHYSICIAN FEE SCHEDULE.—Effective for services furnished on or after January 1, 2009, section 1848(f)(4)(A) of such Act is amended striking ‘‘(such as clinical’’ and all that follows through ‘‘in a physician’s office’’ and inserting ‘‘for which payment under this part is made under the fee schedule under this section, for services for practitioners described in section 1842(b)(18)(C) on a basis related to such fee schedule, or for services described in section 1861(p) (other than such services when furnished in the facility of a provider of services)’’.

At this point you have to jump to another part of the bill to understand everything.

INCLUSION OF MENTAL HEALTH COUNSELORS AS PRACTITIONERS FOR ASSIGNMENT OF CLAIMS.—Section 1842(b)(18)(C) of the Social Security Act (42 U.S.C. 1395u(b)(18)(C)), as amended by subsection (a)(7), is amended by adding at the end the following new clause: ‘‘(viii) A mental health counselor (as defined in section 1861(kkk)(2)).’’. (c) EFFECTIVE DATE.—The amendments made by this section shall apply to items and services furnished on or after January 1, 2011.

SEC. 1309. EXTENSION OF PHYSICIAN FEE SCHEDULE MENTAL HEALTH ADD-ON.
Section 138(a)(1) of the Medicare Improvements for Patients and Providers Act of 2008 (Public Law 110–275) is amended by striking ‘‘December 31, 2009’’ and inserting ‘‘December 31, 2011’’.

A study is NOT an audit, I do not care what it sounds like to you. There is no Audit in this bill relating to physicians services.

You wrote this article about what you claimed was in the bill. I wrote back regarding whether or not your writings were in the bill, not whether or not I thought those issues might come into being. That is a completely different subject.

No. I do not work for, or would ever work for, ACORN. I simply think that misinterpreting what is actually written does not help fight against what is actually in the bill.

It is a terrible bill full of anti-USA freedoms. That is how we need to fight against this bill. Not presuming all kinds of things that are actually not in the bill itself.

We are a free people. We are free to make good or bad decisions and it is not the place of any government agency to rescue us from bad judgements. That will prevent us from learning how to make good judgements.

The primary purpose of the government is to provide a level playing field so we can overcome our mistakes.
