California bans threatening noose displays

California law already bans threatening displays of swastikas or burning crosses. Now add nooses to the list.

On Thursday, Gov. Arnold Schwarzenegger signed legislation making such displays punishable by up to a year in jail and a fine of up to $5,000.

The bill by Democratic Assemblywoman Wilma Carter of Rialto would make it a misdemeanor to hang a noose on someone else's property or at a school or workplace.

She introduced the bill after noose hangings were displayed in several Halloween decorations last year. Two such displays were effigies of then-Democratic presidential candidate Barack Obama and GOP vice presidential candidate Sarah Palin.

The law, which takes effect Jan. 1, will not ban displays by a homeowner, which are considered constitutionally protected speech.

OK, so this autumn the Halloween decorations will have electric chairs instead. Wonder if that will in turn be banned as a “hate symbol.”

People should revolt against this and challenge it in court by wearing the nooses around their own necks.

how is that threatening?

Lets see them fine someone for wearing a noose around their own neck.

I don’t see why Arnold is banning all this stuff. Hell, his father was a Nazi for crying out loud. This should remind him of home.

Actually, the ban seems only to be for hanging the nooses on someone else’s property, without their permission. You can noose away on your own property without restriction.

That’s the way I read it and the reason for the comment.

What he and his backers are doing to this nation calls for something more drastic than just hanging!

Thinking more like what the drug cartel did to agent Campana in Mexico!

Liberty isn't under attack. It forbids hanging nooses (why would anyone sane do that anyway?) from OTHER properties. You can noose around on your own property all you want.

Why do you want to hang nooses on other properties? The bill doesn’t stop you from doing it on your own property.

So let me get this straight...this bill only applies to other people's property. So those "offensive" Halloween displays won't be affected at all. The only thing that will be affected is....politicians' insatiable need to feel good about themselves.

You can hang Pelosi's effigy on your property for all to see.

However I would agree with you about the question whether it pertains also to demonstrations... but doing it on other properties (i.e. your neighbours lawn) is violating his property rights.

Anybody doing that better use a breakaway noose or else some joker will pull it tight.

I didn’t say anything about other’s property.
I suggested the law be challenged by wearing it as a garment... a way of exercising free speech...

Wearing the noose could easily be interpreted as a statement by the wearer that their own freedom has been encroached upon, while protesting the law at the same time.

It was just an idea... civil disobedience.

Sure it did:

As I said, doing this on other properties should be a big no no. How is this reconcileable with property rights, if I hang a noose from your door?

However the problematic bit is whether such displays are banned from protests (I guess so...), in which case it would be a matter of free speech.

There are already laws against trespassing.

This law is aimed not at stopping trespassing, but in squelching free speech.

And there are a lot of things that I don't like, but I don't have the right to outlaw everything I don't like. In a free society we have to put up with things we don't like, like smokers and people who smell bad and people who talk to themselves on street corners. It is fascists like the California Legislature that infringe on liberty by outlawing smoking and wearing perfume or driving without a seatbelt or riding a motorcycle without a helmet.

Our Liberties are being eroded one at a time and people like you cheer on the facists because YOU might not like it if someone actually practiced liberty near you and made you uncomfortable.

What the hell has happened to this forum that we as freepers don't recognize TYRANNY when it rears it's ugly head.

Wake UP! Your Liberty is being stolen from you. That liberty that your forefathers died to give you is being robbed from under your nose!
