Only if you agree that Obama is a "citizen by birth". At the time he was born his father, a foreigner, was here as a student on a student visa. The law then required that he LIST any children born in the USA on his visa.

US citizens, of course, wouldn't be required to be listed on such a visa, but here the law is clear. The question of Obama's claim on citizenship rests initially with his father's status, the legal requirement to be listed on his visa, and whether or not anyone has yet taken action to do so.

Whatever else is involved, the mother wasn't yet 19, and there are legal challenges resting on that problem.

We don't even have to have him born abroad (in Kenya or wherever) to question his citizenship.

We are all now very aware of the fact that Mexican “anchor babies” born a minute after their illegal alien parents cross the border are American Citizens at Birth under the 14th Amendment.
Obama has a certified document from the state of Hawaii with the Registrar’s Seal and signature on it stating that he was born at 7:24 PM on August 4, 1961 in Honolulu.
If and until that document is proved in a court of law to be forged, altered or fraudulent, it stands as proof of Citizenship at Birth.
The very first test of Citizenship at Birth is place of birth within the United States regardless of the status of one’s parents. The only exception to this is children of diplomats from foreign nations.
