Somehow (despite comments here), I doubt this would be an issue with a Moslem school. Heavens, Moslems are never racist (or religionist, or whatever it really is).
One of the social ramifications of the, soon to continue, wave four economic crunch is the halting of all of the nonsense that we have witnessed over the last thirty years...People will have far more important things to worry about than carbon footprints, health-care and treating fringe groups like respectable people... Wonder what would happen if a jewish couple tried to enroll their child in a muslim school and were denied? Would the court come to the same decision, that muslims are racist???? THE COURT WOULDN’T HAVE THE INTESTINAL FORTITUDE, it would cave in and declare Islam a “religion of peace”. THERE’S A REASON I’M AN EX BRIT
The problem was that the schools enrolment policies placed family background ahead of faith as an entry criteria. A criteria solely based on faith is legal - but this schools policies gave preference to practicing Christian children of practicing Christian mothers of Jewish heritage, over practicing Jewish children whose mothers were Jewish converts.
The ruling makes the following clear statement:
This does not mean... that no Jewish faith school can ever give preference to Jewish children. It means that, as one would expect, eligibility must depend on faith, however defined, and not on ethnicity.
Part of the problem is the level of subsidy that independent schools receive from the UK government. If they were truly independent, they would be slightly less vulnerable. But their charitable status is also under attack; losing it would mean they would have to pay high levels of taxation. Home schooling is hardly known.

No it didn't. In "US denominational terms" the case related to the child of a Reform convert mother, attempting to enroll him in an Orthodox school, Orthodox Judaism not recognizing the mothers conversion, thus not admitting him. The court held this to be racist, since other children established their Jewishness based on their mothers faith.

I have mixed feelings about this article.
I think it terrible that the school made the criteria the parent’s level of observance - a most un-Jewish approach. As a test case this stinks.
Nevertheless it is a terrible precedent for the government to butt in.
As to Rabbi Sachs, he is a sorry excuse for a Jewish representative. Jews should leave the UK; it’s done.
This Jewish school gives excellent educations so it is possible non-Jews would want to go there. But who in their right mind would want to go to state funded Muslim schools? No one except Muslims
Jews have attended Catholic schools and universities such as St John’s law school. But no one want to go to Muslim schools but Muslims
So this court ruling is unfair

Apparently that was NOT the basis of this decision.

That is State interference in religion, a terrible decision. And I might add that it will probably single out Jews only since they are unique in their criteria.
I reiterate, Jews are done in the UK.
So are they letitimate converts?
If so, to treat them differently from “native-born” Jews is vehemetly against the Law.

No, the mom is a convert of what’s described as a progressive denomination, the school doesn’t recognize her conversion as legitimate thus her child isn’t Jewish. Same situation here when Orthodox don’t recognize Reform or Conservative conversions. Not a place for the government to be involved

I was unaware any conversions other than Orthodox were recognized by any government.
That is certainly the case in Israel -— that is, the Rabbinate decides who is Jewish and it is Orthodox only (at least for people already in Israel, the rules may be distinct for immigrants).
You are correct - absolutely wrong to treat converts (Ger) differently. It is all over the Torah. I just posted this in another thread.
The issue per JPost is that the child’s mother was not Jewish. The article posted here (Pajamas) does not explain this statement — “I would venture that JFS should have adapted to the modern world and modified its rules to accommodate the children of converts.” The Pajama article is very unclear. Maybe the author did not really understand the issues. I did not see anywhere else a discussion of conversion.
In any event I think it fair for a religious school to decide to adhere to the Orthodox definition of being Jewish (mother) without government interference.
If there was an issue about conversion perhaps it was about the legitimacy. I know that is a hot topic of much dispute including US Rabbis being angry at the Israeli Rabanut.
Since the definition of Jew operates differently than other religions, I can see this race issue being used solely against Jews.
