Someone that is well informed on this topic informed me of the following.

In his NR piece, Andy McCarthy writes:
As far as Obama's eligibility to be president is concerned, it is Hawaii or the highway: If he was not physically born in the U.S., he cannot qualify as a "natural born" citizen. I assumed that was pretty common knowledge, even if the legal reasons why it is so are not well understood. (Obama's mother was too young and hadn't fulfilled indeed, could not at that age fulfill the necessary conditions to pass U.S. citizenship to her child derivatively.)
Interestingly, that may not be true. We have Title 8 §1409 (c):
(c) Notwithstanding the provision of subsection (a) of this section, a person born, after December 23, 1952, outside the United States and out of wedlock shall be held to have acquired at birth the nationality status of his mother, if the mother had the nationality of the United States at the time of such persons birth, and if the mother had previously been physically present in the United States or one of its outlying possessions for a continuous period of one year.
So, it was seem, if the little bastard was indeed a bastard, he skates, even if born in Mombasa. Now, his parents got married in Hawaii in February, 1961. So, at first glance, he would appear to be legitimate, and the above would not apply. However, his parents' marriage was likely invalid because BHO, Sr. already had a wife back in Kenya. In which case, Zero would be in the clear, and all that birther work would be for naught!
