BOSTON – The 911 caller who reported a possible break-in at the home of black Harvard scholar Henry Louis Gates, Jr. did not mention race in the call, according to a statement issued by her attorney and backed up by Cambridge Police Commissioner Robert Haas.
Lucia Whalen placed the 911 call July 16, saying she saw two men on Gates' front porch who appeared to be trying to force open the front door. The call led to the arrest of Gates by Cambridge police on a disorderly conduct charge, and the resulting national firestorm.

The 911 tapes have not yet been made public, but Haas told the Globe that he expected some version of the tapes to be released within the next few days.

In the statement issued Sunday by attorney Wendy Murphy, Whalen — who has not spoken publicly — said she only saw the backs of the two men and did not know their race when she made the call. Murphy said Whalen, who works nearby, called because she had been aware of recent break-ins in the area and wanted to correct “misinformation” suggesting that she placed the call because the men on the porch were black.
He was Gates’s driver home from the airport, and gone by the time the police arrived.

On the other hand, it’s one thing for the police to investigate when you and someone else are seen together trying to apparently break into your own home. It’s another thing for them to demand and report who else was doing what there with you once they’ve determined that you are indeed the rightful resident.
Sadly, next time she something, she may chose to not telephone to avoid all of this turmoi, and it may be real burglars.

Exactly. Who would think you need to hire an attorney just because you reported a potential crime in your neighborhood? I suppose with 0bama inserting himself into the fray, everyone feels vulnerable.
The fact that the police determined that Gates was the owner did not end the need for investigation. The police absolutely should always determine that there is not another person involved who may intend to do harm to the owner. That is why Crowley needed to get Gates out of the house. If my neighbor reports a possible problem at my house and my wife answers the door when the police arrive, I certainly want the police to make certain that she is not in danger from someone who might be in the house and telling her to keep quiet.

That’s true—but it doesn’t mean the driver has to go through the national examination that the poor original 911 caller is suffering, for example.
