Once they are on US Soil, the US Court System becomes involved. From there a Liberal/Progressive Judge or Judges, can choose to feel compassion and let them free upon us or back to fight us overseas - without any other country agreeing contain these individuals.

That is why they have been held offshore. Obama needs the agreement of other country's and or technologies to ensure that these individuals, who have engaged in Terrorism - Outside the Geneva Convention - should not be free to engage in it or support Terrorism ever again.
