This is true and necessary in a republic but the contrary actions must always go towards upholding the Constitution.

What we have now is deliberate actions to "go around" the Constitution.

In such cases, the Supreme Court is obliged to rule such legislation unconstitutional. The check is in the Constitution. It needs to be exercised.

Not only has it not been exercised but the SC itself has enjoined in the Constitutional go around.
