One of the reasons the state agreed to shell out $335,000 to settle a lawsuit over Carole Migden's infamous wild ride and rear-ender was that the then-state senator crashed while on state business.
In this case, however, the "state business" that Migden was on her way to conduct May 18, 2007, was a meeting with former state Assemblyman Joe Nation - who says the topic was the possibility of him endorsing Migden's re-election bid.
"I was scheduled to meet her at Bogie's Cafe in San Rafael that morning," Nation recalled. When he got there, he said, "Carole's scheduler called to say that something unavoidable had come up."
That "something unavoidable" was Migden's weaving, speeding, 30-mile drive through Solano County in her state-issued hybrid SUV. After banging into guard rails and scaring the bejesus out of several drivers, Migden rear-ended Ellen Butawan, whose lawsuit resulted in the $335,000 payout.
Which raises the question: Who made the call that Migden was on state business? Well, it appears it was none other than Migden herself.
"She was the one who filed the claim, and she represented that she was on state business," said Jim Evans, a spokesman for Senate President Pro Tem Darrell Steinberg, D-Sacramento.
Migden, who lost her seat last year to Mark Leno and is now on the Integrated Solid Waste Management Board, said after the accident that leukemia medication she was taking may have played a role in her bad driving.
As for the "state business" question, her attorney, Cris Arguedas, said, "Carole was not going there to ask Nation for his endorsement. She had an office in Marin and a full schedule of state business that day. My understanding was that she was there to talk with Nation about San Quentin Prison."
