The constitutionality issue does not change the fact that he is a sitting president de facto. A sitting president can be legally removed only through the constitutionally prescribed process of impeachment.
Only should the Court or House rule that he is not president de jure can it be concluded that he must be removed.
US Marshalls are under HIS command so they are not going to receive any orders for removal. In fact, I would assume there are no laws even governing such a thing from a federal perspective outside of the normal election law. So he would have to indicted for fraud of some sort, tried and convicted before any police forces could remove him to jail and even then he would not be removed from the presidency unless Congress acted.
Now a decent man like Nixon resigned rather than put the country through an impeachment trial. But self-centered scumbags like Urkle and the Ozark Godfather think nothing about endangering the nation for their own benefit.
Should this continue to fester and court rulings start being issued then my only hope would be for the electorate to vote enough Democrats out in 2010 so that the RAT party would understand that something had to be done. Unfortunately, the electorate seems to be deluded and/or supine. Apparently, it needs to suffer more.
