Why would it not invalidate the entire election?

My read is that it would invalidate the election and with Bush having served two terms already, Dick Cheney would be sworn in and a new election held.

From a pure process point-of-view that would make an eminent amount of sense. It is clean and it is pure, and it can be justified without fancy argument. Go back to where the first foul occurred and restart the game.

No it would not invalidate the entire election since there were two votes for president and vice president. Dufuss Joe would be the next President should the Congress throw Urkle’s butt out of the WH.
