I am probably going to be slammed some for saying this, but I am not going to be in such a hurry to agree with this guys actions. If this happened under George Bush, and we had a soldier who said Bush is not the legal president because he stole the election, so he's not following orders to deploy, we would not be jumping to his defense.
We have had more than one who would not deploy because they thought Iraq was an illegal war - case in point Fort Lewis soldier Lt. Ehren Watada.
The UCMJ is designed to maintain discipline and order in the military, despite who the CIC is.

Different situation. Whether Bush or Gore won, they are Americans. This soldier is questioning his President’s citizenship, and therefore his eligibility.

( NavyCanDo) Bush's case went all the way to the Supreme Court. No court has even agreed to look at Obama's eligibility, so there is a HUGE difference between the two cases.
Also...I am not an attorney, but from reading the court documents it appears that officer is not refusing to obey orders. He is **respectfully** asking for clarification of the legality of the order.

You dont need to be a NBC to be a senator or get a clearance.True, but there would still be a background check and it would have that info, wouldn't it? If so, then someone knows if he is a NBC. Unfortunately, the person/people who know are not leaking; seems leaks only come when a Republican/Conservative is involved.

Agreed.
This guy is definitely in a conscientious conundrum however.
As you alluded, conservatives are generally law-and-order types; so this guy doesn’t appear to be a (true) conservative.
If he were liberal - or course, he would not be making this point.
If he’s an independent, you’d think he wouldn’t care one way of the other...
