What recourse does an army Major have to disobey an illegal order on the basis that the person that issued it is ineligible to give said order?

Straw man scenario mark 1 A:

A civilian orders an Army Major to attack a foreign country, not a president, not even a citizen, just someone that decided to order around the Major because he thinks he can.

There a number of reasons why Obama may not be eligible, not the least of which is that he is not a US citizen Naturalised, native born or Natural Born, The congress and the Supreme Court have both failed to uphold their duty to the Constitution, and now a citizen soldier is obeying his oath to defend it.

George Washington would be proud to lead such a man.

Ummm,, don't thinks so.
George Washington would probably court martial any officer who refused to fight at a time of war - and the officer would probably receive the death penalty.
