The enumeration in the Constitution, of certain rights, shall not be construed to deny or disparage others retained by the people. Correct so that means that abortion is a right under the 9th. Same as gay marriage and a whole host of issues that conservatives fight a losing battle against.
The Declaration is NOT law. It is a statement of protest. I don't see how it can even be interpreted as law much less carry any weight.
