How Ricci Almost Disappeared

For all the publicity about the Supreme Court's 5-4 reversal of Judge Sonia Sotomayor's decision (with two colleagues) to reject a discrimination suit by a group of firefighters against New Haven, Conn., one curious aspect of the case has been largely overlooked.
That is the likelihood that but for a chance discovery by a fourth member of the 2nd Circuit Court of Appeals, the now-triumphant 18 firefighters (17 white and one Hispanic) might well have seen their case, Ricci v. DeStefano, disappear into obscurity, with no triumph, no national publicity and no Supreme Court review.

Illuminating article by Stephen Taylor. Quite a racket they’ve got going there, including their response to Taylor’s email. Thanks for posting and for the link. Hooray judge Cabranes!

Clinton appointee Judge Carbanes HAHAHAHAHAHA I hope Clinton is deeply saddened by this. This is payback for O'Connor's and Souter's betrayals of Reagan and Bush.

Yes they are.
How in the world has Sotomayor operated so long? How many cases has she decided and hidden under the table using her opinion only. She is disgusting and perhaps has cheated honest citizens to the day in court.
How dare she be considered for a position anywhere as a judge; much less the Supreme Court.

Stuart Taylor should be a hero of the right. It was his courageous article pointing out that Paula Jones had a viable law suit against Bill Clinton that revivified her case and kept in motion the affair that was lead to the impeachment of Bill Clinton. I said Stewart's piece was courageous because it ran directly counter to the political correctness of the time. It was a well reasoned piece and he had to defend it on television at much damage to his standing in the salons of Georgetown and the upper West side.

I hope the Republican Senators put her on the hot seat and have her explain all her actions both in an out the court room.

Rosemary Pooler, one of the judges voting with Sotomayor, was for a number of years a Commissioner on New York's Public Service Commission and was the worse political hack one can imagine. She was an anti-nuclear radical. At public sessions she berated professional staff just to give them a hard time because they were carrying out Commission policy; she equated Chernobyl and Three Mile Island; helped make sure that the Shoreham Nuclear plant did not operate; solicited political contributions for herself from the employees of the Department; and in general was a calculating political witch.
Based on what Taylor and Judge Carbanes had to say Sotomayer, Pooler, et al, purposely and deliberately tried to bury those firefighters rights. Those judges ought to be impeached,, fat chance.

I do recall his work during that time. It was encouraging to see rational legal opinion countering the “drag a hundred-dollar bill through a trailer park, you never know what you’ll find” attacker/hack Carville.
