You are attempting to provide reasonable and logical explanation for something that does not exist.
I heard a clip of Holder's comments in reponse to a question at the hearing re the legislation. The question was related to a white preacher being assaulted for a sermon against homosexual acts. Holder said the hate crime legislation would not apply because the preacher was not a person from a group with a history of hate based crimes against them.
“...a history of hate based crimes against them.” is the operative phrase in the legislation.
