EPA fugitive who shot at officers expected to change plea
A Utah fugitive critically injured March 10 during a shoot-out with law enforcement officers in a Marathon trailer park is expected to avoid a trial by pleading guilty today.
Larkin Baggett, 54, formerly of Salt Lake City, was shot in the neck and buttocks after he allegedly pointed an assault rifle at a Monroe County Sheriff's Office deputy and three U.S. Environmental Protection Agency agents.
Baggett was the first man shot by EPA officers in that organization's history.
A change of plea hearing is scheduled today in the courtroom of U.S. Judge Michael Moore at the federal courthouse in Key West.
"Such a hearing usually indicates that a defendant has expressed to the court an intent to plead guilty," said Alicia Valle, spokeswoman for the U.S. Attorney's Office. "However, a defendant can always change his or her mind and proceed to trial."
Valle declined to discuss whether a plea agreement was negotiated with Baggett.
Baggett faces three charges of assault on a federal officer, assault on a person assisting a federal officer and illegal possession of firearms by a felon.
Prosecutors are moving to permanently keep the weapons seized from Baggett's trailer, which included two AR-15 assault rifles, a .308-caliber assault rifle and a pistol that shoots .223 cartridges. It's unclear whether prosecutors also want to seize his property, boat and vehicle.
Baggett was wanted on an EPA warrant for not appearing in court in 2008 on charges of illegally treating and disposing of hazardous waste in Salt Lake City, and illegally discharging acidic chemical waste into the sewer system.

Proper disposal methods are elaborate and consequently expensive; I would guess the EPA misses a lot of cases like this. The USGS released this memo along with the MSDS:
[DISPOSAL:
Spilled or used hydrochloric acid is considered a hazardous waste
and must be handled accordingly. It must be properly labeled and
disposed of by a hazardous waste contractor. Storage should be in
an assigned area that is away from general worker population, and
well-marked, well ventilated and not subject to heat cycles. Records
must be maintained on the amounts of waste hydrochloric acid, the
storage time, and the contractor involved in hazardous waste recycling.
Used hydrochloric acid is considered a hazardous waste because of its
corrosive properties. By diluting hydrochloric acid to 5 percent
volume to volume or less, and neutralizing it with NAHCO3 to a neutral
pH, the solution is no longer corrosive and can, in some jurisdictions,
be disposed of down the drain. Before this is practiced as a means of
disposal, permission must be obtained from the local waste water treat-
ment facility and be in compliance with local and State environmental
regulations.

FDA and USDA agents can be and at times are armed.
There’s no doubt that this guy had run afoul of the myriad and somewhat arcane regulations and permit requirements and paid a rather hefty penalty for it, but as I posted earlier he could have disposed of the waste by simply neutralizing the acids with baking soda had he got the proper permits.
So what was he doing that was so bad? Grilling burgers? The article doesn’t even say.

I don’t know what services are offered by Larkin Baggett’s truck wash, but I didn’t think there was anything nefarious about the name “Chemical Consultants” for a truck wash. Some trucks haul chemicals. They frequently must be washed out between loads of different products, to avoid cross contamination.
if some guy is pointing a gun at and me and my partner is behind him, he’d better fire and hit the perp in the front, back, side, wherever.
Getting shot in the neck and butt by the EPA seems a bit harsher than any of the cleaners he may have flushed down a drain

Consider that the next time you pee (Uric Acid)
If you dumped a 55 gallon drum of Hydrochloric acid down the sewer it would likely react with all the poo and neutralize in 100 feet
Otherwise there would be a hole burned to China in my local tavern

No one is calling this guy a saint but I don't think we need the EPA to shoot him in the neck and the butt in his humble trailer
That's a bit more harsh than anything he may have run down the sewer
