The government should not have the right to take the cards, but neither should the issuing company. They've gotten their money. Traveler's checks do not have an expiration date. American Express and Thomas Cook openly advertise this to their customers and encourage them to keep them for a future trip. A Morgan silver dollar issued in 1890 still has one dollar in purchase power. A three cent postage stamp purchased in 1952 can still be used on a letter.
Gift card issuers who want to avoid giving unused card value to the government have the option of not having an expiration date and many do. Ultimattely, more will join them and provide a better value to the consumer.
