Legislation introduced by veteran anti-gun New Jersey Senator Frank Lautenberg is designed to expand his gun prohibition agenda under the cloak of national security, the Citizens Committee for the Right to Keep and Bear Arms said.
Sen. Lautenbergs new Denying Firearms and Explosives to Dangerous Terrorists Act of 2009 would place unprecedented authority in the hands of the Attorney General to deny someone their Second Amendment rights without having been convicted, or even charged, with any crime. Instead, under this legislation, someone whose name is added for whatever reason to a terrorist watch list can suddenly find himself or herself prohibited from exercising their constitutionally-protected rights based on nothing more than suspicion.
Frank Lautenberg has devoted his entire political career to stripping as many citizens as possible of their firearm civil rights, noted CCRKBA Chairman Alan Gottlieb. His motivation appears to be a Government Accountability Office report that asserts 963 cases of known or suspected terrorists trying to buy firearms over a five-year period from 2004 through February of this year. However, in 90 percent of those cases, the purchases were allowed after the buyer cleared an FBI instant background check.
Lautenberg calls this the terror loophole, he added, yet neither he, nor anyone else, can adequately explain how someone gets their name on a so-called terrorist watch list, and there appears to be no way to get ones name off such a list once it is there.
In Lautenbergs world view, Gottlieb observed, any American citizen interested in owning a gun is a potential terrorist. Would he add all of our names to such a watch list, thus stripping us of our Second Amendment rights, without first being charged, prosecuted and convicted of some crime? Probably he would.
Using the FBI's unreliable Terrorist Watch List to Stop Gun Purchases

The names of the people on the FBI terrorist watch list are secret.
"There is no legal restriction on who can be placed on the watch list, nor is there presently any legal right to have your name removed from the list once it appears.
According to a 2007 report by the Government Accountability Office, an individual may be nominated to the list if they are subject to an ongoing counterterrorism investigation, or if the individual is the subject of a preliminary investigation to determine if they have links to terrorism. The second category potentially includes the entire population of world."
According to the Citizens Committee for the Right to Keep and Bear Arms, a million Americans have been placed on this terrorist watch list without their knowledge. And they can be stopped from getting on a plane, getting a visa, or buying a gun.
The government's consolidated watch list, used to ID people suspected of links to terrorists, has grown to a million names since 9/11, and has drawn widespread criticism over the prevalence of mistaken identities and unclear links to terrorism. RINF reports:

Obama has deliberately and repeatedly lied to America's 90 million gun owners across the country when he insisted that he would not try to take away anyone's firearms. Now his silence endorses Lautenberg's latest attempt at banning guns.
Is your name on the FBI's Terror Watch list? You might not know unless and until you try to exercise your 2nd Amendment right to bear arms.
This is not new....the NRA has been taking this to task for awhile. This crap should not be able to pass both houses with the blue dogs...but it should be watched like a hawk.

This looks like a modified version of HR 45. With the likes of the Lout and holder and nobama in this, they could put whole groups of people on their list. Especially those who are not on the nobama bandwagon.

Anybody else see a really BAD precedent here?
This would effectively allow the government to suspend someone’s Rights based on the inclusion of a secret list.
The same logic to disallow one to buy a firearm could be applied to the exercising the right to free speech, or any of your other rights.
As in: we should allow terrorists to talk to others and recruit them, etc.
We should be able to search their homes, etc. without needing a search warrant.
With terrorism being a dangerous threat, we shouldn’t allow people to remain silent during questioning.
And on and on.
Meanwhile, KNOWN terrorists who don’t have any right under the Constitution or the UCMJ, are afforded these rights without question.
