LAUTENBERG Legislation Cloaks GUN BAN Agenda as Anti-Terror Tool
Citizens Committee for the Right to Keep and Bear Arms | June 22, 2009 | Alan Gottlieb

Posted on 06/30/2009 1:27:54 PM PDT by patriotgal1787

Legislation introduced by veteran anti-gun New Jersey Senator Frank Lautenberg is designed to expand his gun prohibition agenda under the cloak of national security, the Citizens Committee for the Right to Keep and Bear Arms said.

Sen. Lautenberg’s new “Denying Firearms and Explosives to Dangerous Terrorists Act of 2009” would place unprecedented authority in the hands of the Attorney General to deny someone their Second Amendment rights without having been convicted, or even charged, with any crime. Instead, under this legislation, someone whose name is added – for whatever reason – to a terrorist watch list can suddenly find himself or herself prohibited from exercising their constitutionally-protected rights based on nothing more than suspicion.

“Frank Lautenberg has devoted his entire political career to stripping as many citizens as possible of their firearm civil rights,” noted CCRKBA Chairman Alan Gottlieb. “His motivation appears to be a Government Accountability Office report that asserts 963 cases of known or suspected terrorists trying to buy firearms over a five-year period from 2004 through February of this year. However, in 90 percent of those cases, the purchases were allowed after the buyer cleared an FBI instant background check.

“Lautenberg calls this the ‘terror loophole’,” he added, “yet neither he, nor anyone else, can adequately explain how someone gets their name on a so-called ‘terrorist watch list,’ and there appears to be no way to get one’s name off such a list once it is there.

“In Lautenberg’s world view,” Gottlieb observed, “any American citizen interested in owning a gun is a potential terrorist. Would he add all of our names to such a watch list, thus stripping us of our Second Amendment rights, without first being charged, prosecuted and convicted of some crime? Probably he would.

Using the FBI's unreliable Terrorist Watch List to Stop Gun Purchases

"Sen. Dianne Feinstein (D,CA), Frank Lautenberg (D-NJ), and Jack Reed (D-RI) to introduce legislation to eliminate private transfer of firearms and close the nation's Gun Show loophole."

Guest Alan Gottlieb, Chairman

Citizens Committee for the Right to Keep and Bear Arms

"Shocking's a good word... frustrating," says airline pilot and ANG Brig. Gen. James Robinson.

"I'm carrying a weapon, flying a multimillion dollar jet with passengers, but I'm still screened as, you know, on the terrorist watch list."

The names of the people on the FBI terrorist watch list are secret.

"There is no legal restriction on who can be placed on the watch list, nor is there presently any legal right to have your name removed from the list once it appears.

According to a 2007 report by the Government Accountability Office, an individual may be nominated to the list if they are subject to an ongoing counterterrorism investigation, or if the individual is the subject of a preliminary investigation “to determine if they have links to terrorism.” The second category potentially includes the entire population of world."

According to the Citizens Committee for the Right to Keep and Bear Arms, a million Americans have been placed on this terrorist watch list without their knowledge. And they can be stopped from getting on a plane, getting a visa, or buying a gun.

The government's consolidated watch list, used to ID people suspected of links to terrorists, has grown to a million names since 9/11, and has drawn widespread criticism over the prevalence of mistaken identities and unclear links to terrorism. RINF reports:

Thousands of Americans who share common names with supposed terrorists—Robert Johnson, Gary Smith, John Williams, David Nelson, Jim Robinson—have been stopped from boarding planes or otherwise targeted.

The list includes at least one US senator, Edward Kennedy, and three members of Congress, John Lewis, Loretta Sanchez and Don Young, as well as a former US Attorney and an army sergeant flying home from deployment in Iraq. Particularly sinister are cases like those of James Moore, author of a critical biography of Karl Rove, entitled Bush’s Brain, and CNN reporter Drew Griffin, placed on the list in May 2008, shortly after he did a series of investigative reports critical of the Transportation Security Administration.

Obama and the White House are looking the other way as Sen. Frank Lautenberg et al ignore the fallibility of the secret FBI terrorist Watch List and try to ban guns from 1,000,000 U.S. citizens who don't even know they're on it.

Obama has deliberately and repeatedly lied to America's 90 million gun owners across the country when he insisted that he would not try to take away anyone's firearms. Now his silence endorses Lautenberg's latest attempt at banning guns.

Is your name on the FBI's Terror Watch list? You might not know unless and until you try to exercise your 2nd Amendment right to bear arms.

Lautenberg is one of the geniuses who had personal and charitable money with Bernie M.

Voting in favor of this would mean instant defeat for any number of reps and they know it. But thugs like Lautenberg need to be watched very, very closely.

This looks like a modified version of HR 45. With the likes of the Lout and holder and nobama in this, they could put whole groups of people on their list. Especially those who are not on the nobama bandwagon.

One-by-one, the key left-over residues from the former Constitution are being pushed into oblivion.

First Amendment (Free speech related):

Second Amendment:

Many more lists of the eradication strategies (and results thus far obtained) can be generated for the flushing of the 4th, 5th, 10th, 11th, 14th, and, soon, the 22nd.

Anybody else see a really BAD precedent here?

This would effectively allow the government to suspend someone’s Rights based on the inclusion of a secret list.

The same logic to disallow one to buy a firearm could be applied to the exercising the right to free speech, or any of your other rights.

As in: we should allow terrorists to talk to others and recruit them, etc.
We should be able to search their homes, etc. without needing a search warrant.
With terrorism being a dangerous threat, we shouldn’t allow people to remain silent during questioning.

And on and on.

Meanwhile, KNOWN terrorists who don’t have any right under the Constitution or the UCMJ, are afforded these rights without question.
