ENCINITAS — A fundraiser for Francine Busby, who is running for U.S. Congress, ended in chaos Friday night when sheriff's deputies responded to noise complaints and the party's hostess was arrested. Shari Barman, 60, was booked into Vista jail on suspicion of obstructing a peace officer and battery on a peace officer. She later was released. A court appearance has been set for Aug. 11 in Vista Superior Court.
Busby, who spoke at the private reception, said the event was “no different” from hundreds of parties and fundraisers that she has attended.
“This incident is regrettable because it was ... avoidable and unnecessary,” she said in a statement. Deputies first went to the Cardiff home on Rubenstein Avenue at 9 p.m. to issue a warning after a neighbor called and complained about the loud party, sheriff's Sgt. Chuck Yancey said.
They returned awhile later when the party hadn't quieted down, and a deputy asked for Barman's date of birth so he could file paperwork alerting the city to the noise complaints.
Sheriff's officials said Barman refused to give the deputy the information, and that's when things got out of control. A crowd of about 30 to 50 partygoers surrounded Barman when he tried to arrest her, and they were able to separate her from the deputy, Yancey said. Pepper spray was fired on the crowd and the deputies were able to capture her again. At one point, a person refused to let go of her leg so the deputy could take her away. She also allegedly punched the deputy, Yancey said.
Busby's statement said a man shouted an “obscenity-laced tirade” from a wooded area as she spoke to the guests. It said about 25 people were “quietly chatting” when a sheriff deputy arrived and asked to speak to the homeowner.
“When the homeowner asked the deputy sheriff why he needed her date of birth, the deputy reacted by restraining the homeowner,” said Busby's statement. “Alarmed guests pleaded with the deputy to let the 60-year-old homeowner go and stop hurting her. She had recently had shoulder surgery and was clearly in pain. His response was to spray the women with pepper spray which caused confusion and outrage.”
A second woman, 62, was also taken into custody during the melee. She was cited and released.
A sheriff's spokeswoman said Saturday night that she did not know the name of the deputy involved in the incident or whether the department planned to investigate.
The event had been highlighted on Busby's campaign Web site as an evening cocktail party hosted by Barman and her partner, Jane Stratton, who co-founded the Acura Classic tennis tournament in San Diego.
Busby, a Democrat, announced in April her intention to run against Republican Rep. Brian Bilbray for his 50th Congressional District seat in 2010. Bilbray defeated her 53 percent to 44 percent in 2006 to replace disgraced Republican Rep. Randy “Duke” Cunningham who was sent to federal prison in the biggest congressional corruption scandal in history.

Erstwhile and announced future candidate for Congress Francine Busby sure knows how to toss a party. The supposedly “centrist “ Democrat and her followers don’t seem to respect authority too much either. Last night’s event to raise funds for a challenge to Rep. Brian Bilbray would have only been more complete with a good old fashioned flag burning.

On 6/27/09, at about 2112 hours, Deputy ***** and *****, Clinician ***** responded to 1366 Rubenstein Avenue, Cardiff, Calif, regarding a Loud Democratic Rally with Loud Speakers.

She refused to tell Deputy ***** her last name or D.O.B. and walked away from him several times. Deputy ***** followed her and continued to ask for her last name and D.O.B. and she refused his request. As Barman walked away from Deputy ***** again he grabbed her wrist to prevent her from walking away. She resisted and tried to break free of his grasp. Deputy ***** attempted to handcuff Barman as she screamed to the crowd of about 25-40 people. The crowd surrounded Deputy ***** and began pulling Barman away from him.
The crowd was successful in taking Barman away from Deputy ***** and they continued surrounding him. Clinician ***** was pushed out of the way by the crowd and kicked on the back of her leg by an unknown suspect. Deputy ***** took out his pepper spray and used it on the crowd which effectively stopped them from advancing on him. Additionally, it gave him an opportunity to go into the crowd and take Barman back into custody. He attempted to handcuff Barman as she struck him several times on his arms and upper torso with her hands.
Another female later identified as Pamela Ann Morgan began pulling at Deputy *****’s arms trying to prevent him from arresting Barman. Deputy ***** arrived and took Morgan into custody which allowed Deputy ***** time to handcuff and secure Barman. Barman was arrested for 243 (b) P.C.-Battery on a Police Officer and 148 (a) P.C.-Obstructing a Police Officer and was later booked into the Vista Jail. Morgan was arrested for 148 (a) P.C., issued a citation and released from the Encinitas Station. Deputy ***** sustained several scratches and minor swelling on both of his arms.

Documents have now been acquired by The James Hartline Report which show that illegal advertising was utilized to promote the campaign fundraiser of Democratic candidate for congress Francine Busby where a riot broke out during the event on Friday night.
The fundraiser was held at the home of partners Shari Barman and Jane Stratton. Stratton co-founded the Acura Classic tennis tournament in San Diego. The Gay and Lesbian Center in San Diego advertised the campaign fundraiser on their official website calendar for Center Sponsored lesbian, gay, bisexual and transgender events. The San Diego Gay and Lesbian Center is a 501(c)3 non-profit organization. As such, they are forbidden by federal and state law from engaging in the support or promotion of political candidates.
