I agree. Like a warrant that was not properly executed or drafted.
Anything that was found because of that warrant would immediately be thrown out as “fruit of the poisonous tree”
however, having said that, in NY they have let arrests stand based upon bad warrants after throwing out the stuff that was considered wrong.
It depended upon if the court thought that a certain action was “imminent” regardless of the warrant.
