I think you have confused Walpin with some other player. Walpin was nominated by President George W. Bush, confirmed by the Senate, and sworn into office in January 2007. He is on the board of the Federalist Society and once said in a speech "Massachusetts is run by modern-day KKK ... the Kennedy-Kerry Klan."
