I guess we'll have all the details ASAP. One of the first things Obama did (January 21, 2009) was encourage heads of departments and agencies to follow the FOIA

The Government should not keep information confidential merely because public officials might be embarrassed by disclosure

With everything else going on, they may have forgotten this memorandum. Maybe someone needs to send it to them as a reminder. Or maybe it only applies to officials facing embarrassment and not facing criminal prosecution.
