Keep in mind that the first people who tried to topple the Towers were living here in the US and had been targets of the FBI. They deemed the cabal incredible and stopped the surveillance.
Since they had been living here in the US it was only logical to try them here in the US
And we did try them in the US.
What's your point? Are you suggesting Osama lives in the US, so he should be tried here? Or that any of the Guantanamo inmates were arrested here so they should be tried here?
The mistake of the criminal approach to the first Twin Towers bombing was letting the effort stop when the first guys were jailed. The mistake was thinking it was an isolated incident, and not the initial attack of a longer war.
Folks without US citizenship, living here but acting on behalf of a foreign power aren't criminals. They are spies and saboteurs. And we do have a declared war, or did. Military justice is appropriate.
