Sotomayor and the 2nd Circuit affirmed a lower court’s decision that the 2nd Amendment applies only to federal laws and not to states or municipalities.
BUT:
The 10th Amendment is crystal clear: “The powers not delegated to the United States by the Constitution, nor prohibited by it to the States, are reserved to the States respectively, or to the people.”
The 10th Amendement guarantees that the 2nd Amendment applies to all the states, just as the 1st and 14th do. To argue that the 2nd Amendment applies in one state but not another, is akin to arguing that slavery is permissible in one state but not another.
