Has a sitting President ever refused to follow a ruling by SCOTUS?

Lincoln Issues Proclamation Suspending Habeas Corpus Rights
President, military defied Supreme Court

Along with a declaring martial law, President Abraham Lincoln ordered the suspension of the constitutionally protected right to writs of habeas corpus in 1861, shortly after the start of the American Civil War. At the time, the suspension applied only in Maryland and parts of the Midwestern states.

In response to the arrest of Maryland secessionist John Merryman by Union troops, then Chief Justice of the Supreme Court Roger B. Taney defied Lincoln's order and issued a writ of habeas corpus demanding that the U.S. Military bring Merryman before the Supreme Court. When Lincoln and the military refused to honor the writ, Chief Justice Taney in Ex-parte MERRYMAN declared Lincoln's suspension of habeas corpus unconstitutional. Lincoln and the military ignored Taney's ruling.

I think it was filed on Friday. I’ve read that it is a very good sign and it says “whoa, hold on there - this is going too fast and we need to examine the details”. Imho, a real blow to Obama.

It makes sense—it’s a nice rubric by which to define a court’s decisions. I guess my views on it were more using it as a club to bludgeon opponents with, rather than as a system of analysis.

Thanks for posting your views, they are very persuasive.

You are exactly right. It’s all they know. They will find out it’s not that easy in DC unless they try a full blown coup which I would not put past them. I truly fear for the safety of the SCOTUS. If they could get them out of the way, they THINK the sky is the limit. What they haven’t thought about is millions of patriots.... armed patriots who will fight to save their Republic.

That’s a novel concept anymore, probably has been since at least the days of Clinton. Since then has been nothing but the most immature, petty, avaricious partisanship on petty issues of personal power, and no partisanship when needed, on differing worldviews of what America is supposed to be—and it’s NOT part of the NWO.

I agree that there is a best-case scenario worth hoping for, but also submit that there is a worst-case scenario (the formal approval and legal codification of these activities from another branch of government) to be feared.

My thoughts exactly. Sadly, I do not believe SCOTUS will have the balls to "defy" Zero and do the right thing.....
