They are making the exact same argument as the 2nd Amendment incorporation cases are trying to do.
The difference is there is no right to marriage, it is church custom. Government got involved when they realized they could collect fees from the activity.
Nothing prevents anyone from entering into legal agreements about anything. That is what prenuptials are.
