Looking for a Middle Ground on Enemy Combatants

In recent weeks, the President and just about every other major politician from both parties have been boggled by soldier-lawyer disputes. Some have been small: whether or not House Speaker Nancy Pelosi was adequately briefed on the CIA's use of waterboarding in 2002. Others cut to the core of asymmetrical warfare, especially the question of what sort of rights to grant prisoners captured in a war that is likely to be fought in perpetuity against an amorphous, stateless enemy.

It shouldn't be too hard to find a middle ground, theoretically. The soldier and lawyer arguments are being made, in this case, by unappealing extremists. The lawyers, led by the American Civil Liberties Union (ACLU), believe that the detainees should be treated, more or less, under the civil-justice system as described by Article III of the Constitution. The soldiers, misled by former Vice President Dick Cheney, believe that in a time of war, the President has unlimited ability to set the rules necessary to protect the nation.

Putting these people on trial here in the US, opens the door for international trials of our own people, such as our military. If we do it, why shouldn’t the rest of the world?

So lets say we bring the gitmo terrorists here to “live” in our jails with our Constitutional protections.

Are we bringing in their families and extended families so they can visit them? Are we not only bringing in the terrorist but all their families, aunts, uncles, cousins.

I am sick of this crap. These people being held in Guantanamo are not simply “Enemy Combatants”. There were tens of thousands of “Enemy Combatants” we did not incarcerate. We let the vast majority of them go.

These are people through their actions who have demonstrated that they are dedicated to the destruction of the USA, and were either seeking the means or were directly connected to the means to do so.
