Isnt it the right of the States to determine this? Where does it state in the Constitution that the feds have the right to demand this. Just as our water rights......they belong to the States....not the feds. Technically, yes, this should be a state by state issue. But guess what... the US Constitution means absolutely nothing now. States' rights died with the Civil War.
