Who gets to deccide what is hostile? That is the question.
Unless they want to overthrow the 6th Amendment in a pretty blatant way, a jury will decide. Of course a Judge will decide what the jury can hear, and issue instructions on what the law means, and what criteria they can use to make their decision.
