Via Moe Lane. No, he’s not saying that waterboarding terrorists is as evil as genocide, but he does seem to be saying that both are sufficiently evil as to require prosecution. I’d be curious to know how and where he draws the line on prosecutorial discretion, then: When is something so “evil” that we must proceed to trial, damn the policy consequences? Hmmm...

Who is the "we" in this? Did the USA prosecute Nazis or did we extradite suspected Nazis back to Germany for prosecution?

Were the Nuremberg trials a USA trial, or an international war crimes tribunal?

Sometimes I wish the bastards would try it. Then if Republicans get back in control, they can criminalize everything Bammy did. And send the SOB off to prison. Not only Bammy, but Clinton and Carter as well.

The Constitution prohibits Congress from passing an ex post facto law. It doesn't say anything about the President making up such a law on his own, which is what Obama is doing. If the Constitution is in the way, just do an end run.
